Estate planning gives you and your family peace of mind for the future. No matter your age, background, or financial situation, having an estate plan in place is a critical gift that you give your loved ones when they will need it the most. For many Californians, your estate plan should include a revocable trust so that your loved ones can avoid the time-consuming, costly and complicated probate process. At Jarratt Martin Law, P.C., we can create your personalized estate plan, specifically tailored to your family. We can also help you amend an existing plan that no longer fits your family’s needs.
After the death of a loved one, it is sometimes necessary to go through probate. This can be a highly technical and complicated minefield for grieving families. At Jarratt Martin Law, P.C., we navigate the probate process for you. We prepare your petition, create your accounting and move your matter forward in court so that final distributions can be made to the beneficiaries. For small estates, we can also advise personal representatives or executors who will be managing the process themselves as to their responsibilities.
The trust administration process can be complicated. If you have been appointed as a trustee, you’ve inherited a number of obligations for which professional guidance is necessary. These obligations can result in personal liability if not properly performed. At Jarratt Martin Law, P.C., we can represent you in administering the trust, from notifying the appropriate parties and creditors to creating accounting and dealing with tax issues, to making distributions and winding-up the estate in compliance with California law.
Sometimes going to court is inevitable. Whether you are bringing a case against a trustee or you are a trustee defending yourself against creditors or beneficiaries who have brought claims against you, Jarratt Martin Law, P.C. can represent you in court.
If a loved one becomes unable to make decisions for themselves, you can help them by getting the authority to make those decisions in their place. Jarratt Martin Law, P.C. can represent you in a conservatorship proceeding, to get appointed as conservator of the person and/or estate. Once appointed, we can help you manage your duties as conservator, including preparing accountings and required reports and help you seek additional orders from the court. We can also represent you in removing a conservator who is not properly performing his/her duties or in objecting to the appointment of someone who is not fit to serve.
